Supreme Court Tackles Mail Ballot Deadlines: Chaos Looms?

The Grace Period Debate

The Supreme Court is about to decide if 14 states can keep their mail ballot grace periods. Spoiler: it could throw a wrench in the midterms. If the court says no more grace periods, states will scramble, and voters might be left in the lurch. Currently, 29 states give a little leeway, especially for military and overseas voters. But if Mississippi loses, expect chaos.

Stuart Holmes from Washington’s elections office warns that 127,000 ballots might get tossed if Mississippi’s grace period bites the dust. Washington lets ballots roll in up to 21 days late, making it the MVP of grace periods. If the court says a postmarked ballot is worthless, Holmes says, “There’s no second chance.”

Election Day Means Election Day?

Trump’s been yelling about counting ballots after Election Day since 2020, claiming it breeds fraud. Now the Republican National Committee and the Libertarian Party of Mississippi are suing to end grace periods, arguing they violate federal law. They want one day, Election Day, to be the only day.

Opponents say striking down grace periods will create chaos, especially for military and overseas voters. States have the power to set their own voting rules, and they argue grace periods balance speed with security. But if Mississippi loses, chaos might reign in the midterms.

States Brace for Impact

Some states aren’t waiting for the Supreme Court’s decision. Ohio, Kansas, North Dakota, and Utah have already axed grace periods. Minnesota’s trimmed its deadline too. Ohio’s Governor Mike DeWine says he didn’t want to sign off on election restrictions but felt the Mississippi lawsuit left him no choice.

Voters like Adriane Mohlenkamp in Ohio appreciated the grace period as a safety net for their ballots. But with changes at the U.S. Postal Service making postmarks unreliable, states are scrambling to adjust deadlines. Katy Owens Hubler from the National Conference of State Legislatures says any changes need to be communicated fast to avoid voter confusion.
